Our terms of use

1. Agreement to Terms

By accessing or using AeroBrain.ai, AB for Defence, related portals, APIs, software, documentation, demonstrations, integrations, or any associated SkyDynamics services (collectively, the "Service"), you agree to these Terms of Use ("Terms"). The Service is provided by skydynamics llc and its affiliates, representatives, contractors, and licensors ("SkyDynamics", "Company", "we", "us", or "our"). If you do not agree to these Terms, you may not access or use the Service.

If you use the Service on behalf of an airline, aircraft operator, training organisation, defence organisation, ministry, government body, or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

AeroBrain.ai is aviation AI infrastructure and decision-support software for airlines, aviation organisations, and approved enterprise customers. It may include AI-assisted retrieval, analytics, workflow support, agentic tools, operational intelligence, compliance-support features, API access, usage governance, integrations, and related professional services.

AB for Defence is positioned as closed, secure decision-support infrastructure for defence and sovereign environments. It is intended to support authorised analysis, retrieval, monitoring, planning, and governance workflows. It does not replace lawful command authority, rules of engagement, government approvals, safety cases, or human judgement.

We may provide the Service as managed SaaS, private cloud, on-premises, edge, air-gapped, proof-of-concept, demonstration, or professional-services deployments, depending on the agreement with the customer.

3. Enterprise Orders and Customer Agreements

Enterprise or government use may be subject to an order form, statement of work, data processing agreement, security schedule, service-level document, or separate master agreement. If a signed agreement between you and SkyDynamics conflicts with these Terms, the signed agreement controls for the conflicting subject matter.

Public website content, demonstrations, marketing material, and beta features are not contractual commitments unless expressly included in a signed agreement.

4. User Accounts and Authorised Access

Access to the Service may require an authorised account, API key, token, invitation, single sign-on profile, or customer-managed credential. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access to your account

You may not share credentials outside your organisation, bypass tenant boundaries, access another customer's data, or use keys issued to another party.

5. Acceptable Use and Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws or regulations
  • Use the Service in a manner that violates aviation, safety, defence, export-control, sanctions, cybersecurity, privacy, labour, or public-procurement laws
  • Use the Service as the sole authority for flight operations, airworthiness, safety-critical, military, or emergency decisions without authorised human review and applicable approvals
  • Use the Service to design, target, deploy, or operate weapons or autonomous lethal systems outside lawful authorisation and applicable human command structures
  • Transmit any viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or any related systems or networks
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to infringe upon any intellectual property rights of SkyDynamics or third parties
  • Resell, redistribute, or sublicense the Service without explicit written authorization
  • Use automated systems (bots, scrapers, etc.) to access the Service without permission
  • Upload, submit, display, or process data, photos, videos, documents, recordings, likenesses, marks, manuals, or other materials that you are not authorised to use
  • Upload data that you are not authorised to process, including classified, export-controlled, third-party confidential, personal, or operational data outside the approved deployment scope

Violation of these restrictions may result in immediate termination of your account and legal action.

6. Intellectual Property Rights

SkyDynamics and its licensors own all rights, title, and interest in and to the Service, including the software, source code, object code, APIs, interfaces, architecture, models, prompts and orchestration designed by SkyDynamics, retrieval pipelines, workflows, product designs, documentation, trademarks, logos, trade names, know-how, analytics, security controls, audit systems, and all related technology, improvements, derivative works, and proprietary materials (the "SkyDynamics Technology").

Except for the limited rights expressly granted to you in these Terms or a signed agreement, no right, title, license, or interest in the SkyDynamics Technology is transferred to you. You may not copy, modify, reverse engineer, decompile, create derivative works from, resell, sublicense, scrape, benchmark publicly, or otherwise exploit the SkyDynamics Technology without prior written authorization.

SkyDynamics does not claim ownership of Customer Materials, third-party materials, or publicly presented information merely because they are submitted to, displayed in, referenced by, or processed through the Service. Those materials remain owned by their respective owners, subject to the limited processing rights described below.

7. Customer Materials, Prompts, Media, and Outputs

As between you and SkyDynamics, you retain all rights you hold in data, prompts, documents, operational records, manuals, training material, integration content, photos, videos, audio, screenshots, images, likenesses, logos, names, marks, presentations, source references, and other information submitted to, connected with, displayed in, or processed through the Service ("Customer Materials"). SkyDynamics does not acquire ownership of Customer Materials.

You grant SkyDynamics a limited, non-exclusive, worldwide, revocable where legally required, royalty-free license to host, store, reproduce, process, transmit, display, secure, troubleshoot, support, back up, and otherwise use Customer Materials solely as necessary to provide, protect, maintain, improve, and support the Service; comply with law; enforce these Terms; and perform any applicable customer agreement. This license is not a transfer of ownership and does not permit SkyDynamics to sell Customer Materials or use them in marketing, publicity, or external demonstrations without permission.

You are responsible for the accuracy, quality, legality, classification, retention, and authorisation of Customer Materials. You represent that you have all necessary rights, consents, notices, licenses, and permissions to submit, present, display, and process Customer Materials through the Service, including rights relating to photos, videos, recordings, personal data, likenesses, confidential information, third-party content, and regulated operational data.

AI-generated or AI-assisted outputs are decision-support material only. You are responsible for validating outputs before relying on them, especially in operational, safety, regulatory, airworthiness, defence, training, personnel, or customer-impacting contexts.

8. AI Processing and Model Improvement

SkyDynamics may process prompts, Customer Materials, outputs, retrieval traces, metadata, feedback, and audit records to provide the Service, operate tenant isolation, maintain security, resolve support requests, measure usage, improve retrieval quality, and develop or improve SkyDynamics Technology.

SkyDynamics will not use enterprise Customer Materials to train third-party foundation models unless expressly authorised by the customer in a signed agreement or customer controlled configuration. Where a customer chooses to route content to an external provider or integration, that processing may be governed by the provider's terms, settings, and data-processing commitments.

9. Security, Audit, and Customer Responsibilities

SkyDynamics uses technical and organisational measures designed to protect the Service, which may include encryption, access controls, tenant isolation, logging, monitoring, backups, and vulnerability-management processes. No system is perfectly secure.

Customers remain responsible for their own access policies, endpoint security, authorised users, integration configuration, network connectivity, legal basis for processing, operational validation, and any required internal or regulatory approvals.

Audit logs, retrieval traces, provenance records, and usage records may be retained to support security, billing, compliance, dispute resolution, and service integrity.

10. Fees, Billing, and Procurement

Fees, billing terms, usage limits, service credits, procurement obligations, taxes, and payment schedules are governed by the applicable order form, invoice, statement of work, marketplace order, or signed agreement.

Unless expressly stated in a signed agreement, all fees are non-refundable and exclusive of taxes, duties, bank charges, withholding, and public-sector procurement costs.

11. Regulatory, Aviation, and Defence Disclaimers

The Service may reference ICAO, EASA, EU AI Act, NATO, defence, safety-management, or other regulatory frameworks for alignment, mapping, evidence, or discussion purposes. Unless expressly stated in a signed certificate or approval, the Service is not certified, approved, authorised, or endorsed by any regulator, civil aviation authority, military authority, ministry, or international organisation.

The Service does not replace accountable managers, commanders, pilots, engineers, instructors, dispatchers, maintenance personnel, safety officers, legal counsel, or other authorised professionals. Human review, operational judgement, and approved procedures remain mandatory.

Customers are solely responsible for determining whether their intended use requires safety assessment, certification, accreditation, export-control authorisation, cybersecurity approval, labour consultation, union consultation, data-protection impact assessment, or any other legal or regulatory process.

12. Export Controls, Sanctions, and Restricted Uses

You must comply with all applicable export-control, sanctions, defence trade, dual-use, anti-bribery, anti-corruption, and government procurement laws. You may not access or use the Service if you are prohibited from doing so under applicable law, or for any restricted end use without required authorisation.

13. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

SkyDynamics does not warrant that the Service will be uninterrupted, error-free, secure, accurate, complete, compliant with your intended use, or free from viruses or other harmful components. SkyDynamics does not warrant Customer Materials, third-party materials, external integrations, provider outputs, or information supplied by users, customers, public sources, or third parties. You assume full responsibility and risk of loss resulting from your use of the Service and your reliance on any output.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYDYNAMICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL SKYDYNAMICS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO SKYDYNAMICS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless SkyDynamics, its officers, directors, employees, contractors, agents, affiliates, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, fines, penalties, and costs, including reasonable attorneys' fees, arising from or related to your Customer Materials, your use of the Service, your violation of these Terms, your breach of any representation or warranty, your violation of law, or your infringement, misappropriation, or violation of any rights of another party.

15. Termination

SkyDynamics reserves the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion features in the Service. Upon termination, we may delete or retain your Customer Materials in accordance with our Privacy Policy.

16. Governing Law and Dispute Resolution

Unless a signed agreement states otherwise, these Terms are governed by the laws of Greece, without regard to conflict-of-law rules. The competent courts in Greece shall have jurisdiction, subject to any mandatory rules that apply to public authorities, consumers, or regulated procurement.

Before filing a claim, the parties will make a good-faith effort to resolve disputes through executive escalation and written notice, except where urgent injunctive relief is required.

17. Changes to Terms

SkyDynamics reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SkyDynamics regarding the use of the Service and supersede all prior agreements and understandings.
